    1. Agreement to Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you and Water Proof Specialist (PVT) LTD ("Company," "we," "us," or "our") concerning your access to and use of our website and waterproofing services in Sri Lanka. By accessing our services, you agree to be bound by these Terms.

    2. Services Provided

    2.1 Scope of Services

    We provide professional waterproofing services including:

    • Roof waterproofing and coating
    • Wall and basement waterproofing
    • Bathroom and wet area waterproofing
    • Concrete repair and restoration
    • Emergency leak repair services
    • Preventive maintenance programs

    2.2 Service Limitations

    Services are subject to technical feasibility, site conditions, and availability of materials. We reserve the right to refuse service if conditions are deemed unsafe or impractical.

    3. Quotations and Pricing

    3.1 Free Assessments

    Initial site assessments and quotations are provided free of charge and are valid for 30 days unless otherwise specified.

    3.2 Pricing

    • All prices are quoted in Sri Lankan Rupees (LKR)
    • Prices are subject to change based on material costs and scope changes
    • Additional charges may apply for emergency services
    • Quotations are binding once accepted in writing

    4. Payment Terms

    4.1 Payment Schedule

    Standard payment terms are:

    • 30% advance payment upon agreement
    • 40% payment upon project midpoint
    • 30% final payment upon completion

    4.2 Payment Methods

    We accept:

    • Bank transfers
    • Cash payments
    • Cheque payments
    • Credit/Debit cards (for applicable amounts)

    4.3 Late Payments

    Late payments may result in project suspension. Interest may be charged on overdue amounts at the rate of 2% per month.

    5. Project Timeline

    • Timelines are estimates and subject to weather conditions
    • Delays caused by client or third parties are not our responsibility
    • We will notify clients of any expected delays
    • Emergency repairs are prioritized and scheduled accordingly

    6. Warranties and Guarantees

    6.1 Workmanship Warranty

    We provide warranties ranging from 5 to 15 years depending on the service and materials used, covering defects in workmanship and materials.

    6.2 Warranty Conditions

    Warranties are void if:

    • Structural alterations are made without our consultation
    • Regular maintenance is not performed as recommended
    • Damage results from natural disasters or external factors
    • Unauthorized repairs or modifications are made
    • Payment terms are not fulfilled

    6.3 Warranty Claims

    All warranty claims must be submitted in writing with supporting documentation within 7 days of discovering the issue.

    7. Client Responsibilities

    • Provide accurate information about property conditions
    • Ensure site access for workers and equipment
    • Secure valuable items and clear work areas
    • Obtain necessary building permits (if required)
    • Follow maintenance recommendations provided
    • Make timely payments as per agreement

    8. Liability and Indemnification

    8.1 Limitation of Liability

    Our liability is limited to the contract value of the specific project. We are not liable for indirect, consequential, or incidental damages.

    8.2 Insurance

    We maintain appropriate insurance coverage for our operations. Clients are responsible for their own property insurance.

    9. Cancellation and Refunds

    9.1 Client Cancellation

    • Cancellations before project start: 50% refund of advance payment
    • Cancellations after project start: Charges for work completed plus materials
    • Emergency service cancellations: Full callout charges apply

    9.2 Company Cancellation

    We reserve the right to cancel projects if safety concerns arise or if payment terms are not met. Full refund of advance payment will be provided in such cases.

    10. Intellectual Property

    All designs, methods, and proprietary techniques used by Water Proof Specialist remain our intellectual property. Clients may not reproduce or distribute our methods without written permission.

    11. Dispute Resolution

    11.1 Informal Resolution

    We encourage clients to contact us directly to resolve any disputes or concerns.

    11.2 Mediation

    If informal resolution fails, parties agree to mediation before pursuing legal action.

    11.3 Legal Jurisdiction

    Any legal disputes shall be governed by the laws of Sri Lanka and subject to the jurisdiction of courts in Gampaha District.

    12. Force Majeure

    We are not liable for delays or failures in performance resulting from acts beyond our reasonable control, including natural disasters, strikes, wars, or government restrictions.

    13. Privacy and Data Protection

    Your personal information is handled according to our Privacy Policy. We comply with applicable data protection laws in Sri Lanka.

    14. Amendments to Terms

    We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website. Continued use of our services constitutes acceptance of modified Terms.

    15. Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
